Know-how and company secrets

Bryn Aarflot

What is knowhow and company secrets?

Know-how and company secrets can be defined as knowledge belonging within a company. Typical examples of such knowledge, particularly within the technical industries, are details of production methods and production experience. Knowledge within the company has its own commercial value and needs to be kept out of the hands of competitors. It should not be disseminated. The law provides a basis for the protection of know-how and company secrets, but it can be difficult to demonstrate that the situation you are in satisfies the provisions of the Act. The protection of such information is therefore largely dependent on competent lawyers following the correct procedure. At Bryn Aarflot, we are experts on the rules for unfair competition within the Marketing Promotion Act and have extensive experience of the protection of know-how and company secrets.
